How Lendly Capital collects, uses, and protects information submitted through this site and through the loan process.
This Privacy Policy describes how Lendly Capital ("Lendly Capital," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information in connection with lendlycapital.com, financing inquiries, and our lending activities. We are a private real estate lender headquartered at 26565 Agoura Rd #200, Calabasas, California, operating under CA DRE License #02066200. We fund non-owner-occupied, business-purpose loans for investment properties only.
Please read this Privacy Policy carefully to understand our practices regarding your personal information. This policy does not itself create contractual rights or obligations beyond those imposed by applicable law.
Depending on how you interact with us, we may collect the following categories of personal information:
We collect personal information primarily from you directly, including through website inquiry forms, email, telephone, text message, and documents you provide during underwriting or servicing. We may also receive information from brokers or other representatives acting on your behalf, service providers involved in a transaction, public records, and other sources used for underwriting, fraud prevention, verification, closing, or servicing.
If you submit information about another person, including as a broker or representative, you represent that you are authorized to provide that information to us.
We may use personal information to respond to inquiries; evaluate, size, underwrite, document, close, fund, administer, and service loans; communicate about transactions; verify identity, ownership, and submitted information; prevent and investigate fraud or security incidents; maintain business and transaction records; comply with legal, regulatory, licensing, tax, and recordkeeping obligations; operate and protect our website and systems; enforce our agreements and protect our rights; and provide information about our loan programs where permitted by law.
When you submit an inquiry, we may contact you about that inquiry by phone, email, or text. Based on our current practices, we do not use automated dialing systems or bulk text campaigns for these communications. You may ask us to change your communication preferences by contacting your representative or using the contact information below.
We may disclose personal information as reasonably necessary to operate our business and complete or service a transaction, including to title and escrow companies, appraisers, inspectors, insurance providers, legal and professional advisors, loan servicers, hosting and technology providers, customer relationship management providers, and other vendors that support our operations. We may also disclose information to regulators, law enforcement, courts, or other parties when required by law or legal process, and when reasonably necessary to protect our rights, prevent fraud, or address security concerns.
We do not sell personal information or rent or trade personal information for third parties' own marketing purposes. We do not use borrower files as lead lists. If you are a broker, our stated practice is not to use information submitted for your transaction to solicit your borrower during that transaction or after closing.
Based on the current configuration of this website, Lendly Capital does not intentionally set first-party advertising or analytics cookies and does not intentionally operate advertising or social-media tracking pixels on the site. Our hosting provider may nevertheless record ordinary server-log information when pages are requested.
Because browser-based "Do Not Track" signals are not currently governed by a uniform industry standard, this website does not currently respond to Do Not Track signals. We do not currently use the site for cross-context behavioral advertising. If our tracking practices change, we will update this policy and provide any controls required by applicable law.
We retain personal information for as long as reasonably necessary for the purposes described in this policy, including evaluating inquiries, completing and servicing transactions, maintaining business records, resolving disputes, preventing fraud, enforcing agreements, and satisfying legal, tax, licensing, and regulatory obligations. Retention periods vary according to the nature of the information and the reason we hold it. Records associated with a funded or closed loan may be retained after payoff where required or reasonably necessary for these purposes.
We use administrative, technical, and physical safeguards designed to protect personal information in light of its sensitivity and limit access to personnel and service providers with a business need for it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send tax returns, bank statements, identity documents, or similarly sensitive records through unprotected email; ask your representative for an available secure method of transmission.
Depending on where you live and which laws apply, you may have rights concerning your personal information, such as requesting access to, correction of, or deletion of certain information. These rights may be subject to exceptions, including obligations to retain transaction, legal, regulatory, fraud-prevention, or other records. We may need to verify your identity and authority before acting on a request.
You may also ask us to stop or limit marketing communications. A request to stop marketing does not prevent us from sending communications reasonably necessary to respond to an inquiry, administer a transaction, service a loan, or comply with law.
California residents may have privacy rights under applicable California law. Where a California privacy law applies to Lendly Capital and to the particular information at issue, we will honor the rights and procedures required by that law, which may include rights to know or access, correct, or delete certain personal information and rights not to receive discriminatory treatment for exercising applicable privacy rights.
Certain information, entities, transactions, or activities may be outside the scope of particular California privacy statutes or subject to statutory exemptions. We will evaluate requests under the laws applicable to the information and relationship involved. To submit a privacy request, contact us using the information in Section 14 below. We may request information reasonably necessary to verify your identity or authority to act for another person.
Our website may contain links to websites or services operated by third parties. Their privacy practices are governed by their own notices and policies, not this Privacy Policy. We encourage you to review the privacy practices of any third-party service you use.
Our website and lending services are intended for adults engaged in business-purpose real estate transactions and are not directed to children under 13. We do not knowingly collect personal information from children under 13 through this website. If you believe a child has provided personal information to us, please contact us so we can review and address the matter.
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or business operations. We will post the revised policy on this page and update the "Last Updated" date above. Where applicable law requires additional notice or consent for a material change, we will provide it.
